In April 2010, the Department of Labor announced its “Plan, Prevent, Protect” initiative. The DOL is considering new recordkeeping rules to require employers to provide wage statements to employees, as well as requiring employers to notify workers whether they’re employees or independent contractors. Moreover, the DOL and the ABA started an “attorney referral system” to help employees pursue minimum-wage and family/medical-leave complaints against their employers. In a nutshell, the DOL wants employers to take more steps to prove compliance, and wants to give employees more information to help them monitor employer compliance.
